Terms and Conditions for Creator Lord Design (CLD)

 

1. Scope of Services

Creator Lord Design (CLD) offers design services for a wide range of products, from small items to full automotive vehicles. The terms of each design project may vary based on the complexity and scale of the product being created. Clients will receive a detailed scope and payment structure for each individual design.

2. Payment Terms and Structure

CLD is committed to offering competitive and transparent payment structures. Payment terms will be tailored to each client's needs and the scope of the project. In the current market, we aim to provide flexibility with affordable payment plans, offering clients greater convenience and reduced financial stress during the design process.

  • Advance Payment: A 10-15% advance payment will be required to initiate the design process, with the remaining balance due upon completion of the design or before delivery of final files.

  • Payment Flexibility: To ensure ease of payment, CLD offers a flexible installment plan, which can be customized based on the size and complexity of the design. Clients can choose from monthly or milestone-based payments to ensure a smooth flow of finances throughout the project.

3. Handling of Advanced Payments

CLD ensures the client's advance payment is safely handled and applied directly to the design process. If a project is delayed or canceled due to any issues from CLD's side, the advance will be refunded in full. In case of cancellation or modification of the project by the client after work has commenced, CLD will retain a portion of the advance as a processing fee, in alignment with industry standards.

  • Refund Policy: In the event that CLD fails to deliver the design within the agreed timeline, clients are entitled to a 100% refund, including the advance payment, along with the work completed until that point.

  • Work Suspension: If the client decides to cancel the project after work has started, no refund will be issued, but the client may receive the completed designs, if any, based on the terms outlined in the contract.

4. Non-Commercial Use & Commercialization

  • Non-Commercial Use: CLD provides its designs under a Creative Commons Attribution-NonCommercial (CC BY NC) license. Clients can use, modify, and distribute the designs for non-commercial purposes, with the following conditions:

    • The original name and logo of the vehicle (or product) must be retained.

    • Proper credit must be given to Creator Lord Design (CLD), and clients must tag CLD on relevant platforms if using the designs publicly.

  • Commercial Use: For clients seeking to use the designs for commercial purposes (mass production, reselling, etc.), royalties will apply. Royalties are based on a percentage of the generated revenue from commercial sales, or a one-time payment, as per the terms outlined in the contract. If a client wishes to purchase the full rights to the design for commercial use, this option is available for negotiation.

5. Design Ownership & Showcase Rights

Once the service fee is paid in full, the client will have ownership rights to the design. Clients can choose whether they wish to showcase their design on our platform or in our portfolio. If they wish to showcase the design, this must be explicitly stated in the contract. CLD will honor the client’s wishes regarding how the design is displayed, ensuring proper acknowledgment of ownership while maintaining CLD’s role in its creation.

 

Additional Points:

  • Custom Design Requests: If a client wants to request a custom design, they must submit a detailed brief through our support page. A 10-15% advance payment will be required for custom design projects, with the remaining balance due upon completion. Design specifications cannot be changed after they are agreed upon, and any cancellation will result in a non-refundable advance fee.

  • Jurisdiction & Legal Considerations: All legal matters related to this agreement will be governed by the jurisdiction where CLD's headquarters are located, which is currently in India.

  • Terms Updates: CLD reserves the right to update these terms and conditions at any time. Clients will be notified of any significant changes, and updated terms will apply to ongoing projects unless otherwise agreed upon.
